1064239 BC Ltd dba Ceremonie Spirit + Beauty Liability Waiver
Courses, workshops, gatherings, mentorships, retreats, and other events (herein referred to as “The Activities”) will be held online by Ceremonie Spirit + Beauty and Open Minds Performance (referred to herein as CEREMONIE.)
1. Assumption of Risk
I expressly and voluntarily assume all risk while participating in the Activities or in any aspect of the Activities, whether or not caused by negligence of CEREMONIE, and any of its owners, directors, employees, representatives, agents, contractors or volunteers (collectively, the “Released Parties”). I understand that my use and enjoyment of any physical components within the Activities involves inherent risks, both those described herein and other risks, that are serious and that may involve dangers regardless of the care taken by CEREMONIE or the Released Parties. I realize my use and enjoyment and participation in the Activities require some degree of skill, coordination, and physical fitness. I understand that it is my responsibility to know where I am at in my physical condition and skill level, and I hereby assert that my participation in the use and enjoyment of the Activities is voluntary and that I knowingly assume all inherent risks of the Activities, both those described herein and others presently unknown.
2. Client Use of Images + Press Policy
The Client understands that, in order to ensure that participants feel that their privacy during Activities is protected, and to ensure a full and open interchange of ideas among participants, they agree that they will not post writings on social media or blog about their fellow apprentices or their stories or experiences. The Client agrees to obtain prior written permission from CEREMONIE before including content pertaining to any experiences therein in articles in magazines, books, video interviews, etc. Those who are attending an event, course, program, retreat, series, workshop, or other form of gathering, online or in-person, are permitted to post to personal social media pages regarding their personal experiences as educational storytelling, taking care to use quotes and tag appropriate parties and giving credit where credit is due is allowed and in fact can be quite valuable to the long-term sustainability of our endeavor. Posting to blogs of companies that the Client is affiliated with or employed by but not the owner, or including writing or photos from our program in magazines or blogs other than their personal page is prohibited. If the Client's personal and business account are merged, simply take care to not use our photos, quotes, or teachings for posts promoting their own goods or services. If in doubt about whether or not an intended post is honoring or appropriate, just ask! CEREMONIE is always available for open dialogue concerning ethics of sharing.
3. Photography, Video, and other Forms of Content
By entering the Activities, the Client, and all participants, agree to the following terms, conditions, and guidelines for the use of any imagery obtained during the Activities, including still photographs and videos (hereinafter “CEREMONIE Imagery”). CEREMONIE monitors dissemination of participant-related Imagery to ensure that Imagery is not used for any purpose other than “Personal Use,” and are not used for any other purpose, including without limitation, for advertising or commercial purposes. Participants may use CEREMONIE Imagery only for “Personal Use,” defined to include: (1) sharing with friends and family; (2) displaying on personal websites (as long as the placement on the website does not in any way suggest these images in association with your own products or services, and does not purport or appear to be an official website of the apprenticeship) and (3) displaying on personal accounts, on photo sharing and social networking websites, such as Instagram and Facebook (as long as the display of the CEREMONIE Imagery on these sites is not commercial or promotional in any manner and the account is not affiliated with any commercial enterprise. The Client understands and accepts that they may not make use of CEREMONIE Imagery without prior written permission from CEREMONIE other than personal use (as defined above). The Client understands that they have no right to sell, transfer, license, or sublicense their CEREMONIE Imagery to any other party and agrees to inform anyone to whom they give any CEREMONIE Imagery that it can only be used for Personal Use. The Client understands that they may not use or allow to be used any CEREMONIE Imagery in any media article, newspaper article, video, blog, advertisement, or promotional materials, except with the prior written consent of CEREMONIE. The Client understands that if they record CEREMONIE Imagery with the intention to utilize it for non-personal use, they will be trespassing, and that trespassers have no rights to any use of CEREMONIE Imagery, and CEREMONIE reserves the right to take any necessary action against trespassers.
4. Model + Participant Release
CEREMONIE does record certain events or programs, using authorized photographers. When the Client enters a CEREMONIE event or program, they enter an area where photography, audio, and video recording by CEREMONIE may occur. By entering the Property and attending the event, course, program, retreat, series, workshop, or other form of gathering, online or in-person, the Client hereby assigns to CEREMONIE the irrevocable and unrestricted right to use and publish, display, exhibit, reproduce or use the recordings for commercial use which the Client may be included for editorial, trade, advertising, educational and any other purpose and in any manner or medium that CEREMONIE designates and to alter the same without restriction. The Client releases all claim to profits that may arise from use of any images. The Client agrees to release CEREMONIE, its officers, agents, representatives, and employees, and each and all persons involved, from any liability connected with CEREMONIE’S taking, recording, digitizing, publication, and use of interviews, photographs, video and/or sound recordings at the Activities. By the Client's willing participation in an event, course, program, retreat, series, workshop, or other form of gathering, online or in-person, they consent to the recording of such gathering and the sale of the recording without compensation.
5. Alcohol and Drug Policy for All Live Courses, Series, Events, and Other Gatherings
At all Ceremonie events, whether online or in-person, attendees are required to be sober throughout the duration of the event. We have a strict no alcohol and drug policy in place to ensure the safety, well-being, and meaningful engagement of all participants. This policy applies to all attendees, including participants, staff, and volunteers. Any violation of this policy may result in removal from the event without refund or credit. We prioritize creating a supportive and focused environment for personal growth, learning, and connection. By adhering to this policy, we aim to foster a respectful and inclusive space for everyone involved.
6. Medical Advice
The Activities essentially provides an online space where persons can share ideas, information and skills with others and learn and grow together. I understand that ALL activities are simply offerings, and I am under no obligation to partake in anything that I am not comfortable with for any reason. Furthermore, it is my own responsibility to check in with a qualified health care professional with any questions I may have about whether or not to participate in any of the activities, and to seek professional advice regarding participation in any herbalism based activities or culinary offerings. CEREMONIE claims no responsibility or liability for any of the activities, and I hereby release CEREMONIE and all of the Released Parties for any discomfort, hardship, or injuries that I may sustain relating to any of the Activities or offerings.
7. Medical Waiver and Release
I assume all responsibility for the decisions I make concerning my health care or in response to suggestions, recognizing that (a) no claims are made about herbal medicine, lifestyle changes, nutritional, dietary recommendations to treat or cure any medical condition, (b) there is no applied or stated guarantee of success or effectiveness of any specific plan or treatment, and (c) I am free to act on or disregard the recommendations of wellness or first aid personnel at the Activities. I consent to have medical treatment that may be deemed advisable in the event of injury, accident, and/or illness during the Activities, and I agree to be responsible for the payment for all costs of emergency medical care and transportation. I hereby release CEREMONIE, the Released Parties and any and all persons participating in the provision of wellness, first aid or any medical treatment to me at the Activities from any responsibility or liability relating to access to first aid, providing suggestions to me concerning first aid, for my decisions about what type of wellness, first aid or medical aid to use, and for any emergency first aid that is provided to me.
8. Release and Waiver of Liability
I release and discharge the Released Parties from any and all liability, claims, demands or causes of action that I may hereafter have for any injuries, damages or death arising out of my participation in the Activities. I do hereby release, waive, discharge, and covenant not to sue the Released Parties and hold them harmless from liability for any and all claims arising from my use and enjoyment of the Activities, including any injury resulting from the ordinary negligence of the Released Parties.
9. Indemnification
I further agree to hold harmless, defend and indemnify the Released Parties from any judgment, costs, damages, including investigation costs, attorneys’ fees, expert fees, and related trial, litigation, arbitration, and/or mediation costs and expenses, relating to any and all claims made against CEREMONIE or any of the Released Parties relating to any conduct by me during the Activities.
10. Refund Policy
As stated prior to registration and on shopceremonie.com, there are NO refunds, credits, exchanges, or registration transfers are given for any reason.
11. Force Majeure
CEREMONIE intends for us to meet and experience each other online. However, I agree that CEREMONIE is not liable for acts of God, the weather, strikes, protests, wifi disruption, or actions taken by government agencies and similar causes, which may interfere with the Activities. I understand that tuition is non refundable even if the Activities is terminated early or cancelled, or entry conditions are modified, due to harsh weather, acts of nature, governmental regulation, the failure to obtain required governmental permits, or other conditions beyond CEREMONIE’s control.
12. Acknowledgements and Additional Agreements
I acknowledge and/or agree as follows:
I possess sufficient physical fitness and coordination to enable safe use and enjoyment of the Mentorship and its Activities.
I assume the risk of all of my medical conditions (e.g. asthma, diabetes, anaphylaxis, epilepsy, heart disease, allergies, sensitivities, or high blood pressure).
CEREMONIE encourages me to get medical clearance prior to use and enjoyment of the Mentorship.
I will cease use of the physical activities within the Mentorship if there is discomfort such as faintness, shortness of breath, high anxiety, or chest pains.
I agree to abide by all safety-related rules while using and enjoying the Mentorship and the and to attempt only such use as I feel capable of performing safely.
I understand the importance of rules and agree to follow all instructions, guidance, and warnings given by CEREMONIE and its duly authorized representatives.
I acknowledge that CEREMONIE has the authority to terminate my participation in the Activities if it is deemed a physical, emotional or psychological danger or harm to CEREMONIE, others or me.
Furthermore, as CEREMONIE is a private business, CEREMONIE reserves the right to refuse individuals admittance to the program if there is any indication that the individual(s) is not a good fit for the program.
13. General
I confirm that these rules, liability waiver, and indemnification provisions supersede any and all previous, oral or written promises, or agreements regarding the subject matter hereof (including any statements made on the CEREMONIE website) and understand that this is the entire agreement between me and the Released Parties as to the subject matter hereof and cannot be modified or changed in any way except in a writing signed by an authorized representative of CEREMONIE. I expressly agree that the foregoing rules, liability waiver, and indemnification provisions are intended to be as broad and inclusive as is permitted by the laws of Canada and that if a portion thereof is held invalid, it is agreed that the balance shall continue in full legal force and effect. I agree that by signing below, I accept the terms of these Terms and Conditions, my act of accepting thereby shall confirm that I have read and understand these Terms and Conditions, and that I agree to all of its terms.
14. Late Enrolment
Late enrolling apprentices: I will be expected to catch up on missed lessons and homework independently without additional instruction from CEREMONIE (there will be replay link(s) of missed lesson(s) available for me to access), and without taking up space during lessons on already covered content, and that tuition will not be prorated.
15. Payment Plan Agreement
For the payment plans for the Mystery Mentorship modules, by this contract, the Client agrees to pay for the Mystery Mentorship services rendered by 1064239 BC Ltd DBA Ceremonie, hereafter referred as the Company, by the following schedule in exchange for the purchased Mystery Mentorship Module(s)’ content.
By this agreement, it is agreed that a payment of the [designated amount] will be rendered to the Company every month for the next [specify number of months] until the total of the payment required, which is [specify] has been delivered. The first payment will start upon enrolment in the Mystery Mentorship Module(s), and will end after the determined number of payments, 30 days apart, based on the payment plan option purchased.
If, under whatever circumstances the Client’s credit card changes, Client must contact the Company immediately with updated credit card details. This agreement is binding, and failure to meet its terms will allow the Company to take certain recourse.
16. Non-Negotiables When Enrolled in Any of Ceremonie’s Programs (Homing Coven, Courses, Series, Retreats, or other Events)
There are some essential parameters and codes of conduct that form the consensus to experience the program in a safe, inclusive, and effective environment suitable for learning. Individuals who cannot meet and respect these codes of conduct, and are unwilling to engage in accountability or feedback will be asked to leave the Program(s), and NO refunds NOR credit will be provided. They are:
Follow the first principle of harming none.
Follow the second principle of taking responsibility for your actions. This is critical as each of our energy has a profound impact on others.
Please leave your ego at the door. This includes spiritual ego. No exceptions.
No part of the content is to be shared/reposted as own, resold, plagiarized, or appropriated.
Any form of sexism, harm towards the LGBTQIA+ community, xenophobia/racism, fragility, or other forms of harmful intolerance, will not be endured and if exhibited, you will be asked to leave the coven and NO refunds will be provided.
No spiritual bypassing, including spiritual bypassing of racism or other forms of harm.
The Programs are not a ‘marketplace’ to promote your organization.
Show up to your gatherings and practices sober: At all Ceremonie gatherings and practices, whether online or in-person, attendees are required to be sober throughout the duration of the event. We have a strict no alcohol and drug policy in place to ensure the safety, well-being, self and mutual accountability, and meaningful engagement of all participants.
We each are responsible for holding respectful and on-topic space for the group.
In this Programs, we do not gossip, speak of others behind their backs, spread rumours, scapegoat a member, or recruit others to your point of view at the expense of another member.
Simultaneously, when a concern arises, we approach the situation with maturity, willingness, and curiosity to learn and then take ownership for our role in a dynamic.
Working communally invites different communication styles and perspectives, and in most cases, the different perspectives are from the unique intersections of family upbringing, race, culture, personality, faith, education, neuro-type and ability, and levels of privilege. This diversity doesn’t equate to, but can occasionally lead to conflict. We support each other in putting forth ideas / approaches freely and without personal attacks or other forms of hurtful behaviour. We also are committed to finding ways to hold complexity and nuance while maintaining consensus on respect and safety.
Should the occasional conflict arise between members, the parties will mutually approach it with honesty, maturity, and kindness. Folks directly in the conflict will engage each other privately, and if the conflict cannot be resolved or neutralized, will ask for help and mediation from Mimi.
A complete and fruitful apology consists of embodied acknowledgement, verbally expressing what caused the harm, making the suitable amends, and reflecting on how to prevent a similar action from repeating.
